I wish to notify your organization that IDT was recently contacted by both the Commissioner of the County of Allegheny as well as his Department of Law concerning the above web site. The Commissioner’s Office expressed their concern over the fact that the Commissioner’s picture is displayed adjacent to text that he has not authorized, nor does he support.

From a purely legal standpoint, IDT agrees that the placing of the Commissioner’s picture immediately next to the particular text gives off the impression that the Commissioner endorses your position. Hence, the Commissioner’s Office could have a potential cause of action for both misrepresentation and/or misappropriation.

In light of recent federal legislation, IDT now has an affirmative duty to notify you, the owner of the web site, of the alleged violations that your organization may be committing. Moreover, if your organization chooses to keep the web page in question as is, IDT has a further duty to either block access to this particular page or remove the entire site from our system.

IDT values you and your organization’s business. Your organization has been a customer in good standing for a number of years and IDT sincerely wishes to resolve this matter in an amicable fashion.
