8th of February, 1999 Mr. Hershel Snukal IDT Corporation 190 Main Street Hackensack, NJ 07601 Re: haven.ios.com/~voice29/comment.htm Dear Mr. Snukal: I am in receipt of your letter dated February 3, 1999, concerning the aforementioned web page. I must first question the motives of Allegheny County Commissioner, Bob Cranmer for contacting my internet service provider (ISP) on a web page that is satirical in nature. Since you have no, or little knowledge on the history of the public funding of stadiums, or Commissioner Cranmer’s involvement which is the basis of this page, I must believe that IDT’s actions are the results of a knee-jerk reaction from being bullied by Government Bureaucrats. First, I deny the implication of the text at issue as portraying the endorsement of Commissioner Bob Cranmer. This web page is political satire, which is a form of political speech. This web page also parallels political cartoons, which are more critical of elected officials than our web page, yet are routinely published in our daily newspapers across America. This form of political expression is also protected under the 1st Amendment of the U.S. Constitution. As the Chairman of Voice PAC, we would expect no more, than the same latitude of protection as our "Free Press". In reviewing the contract that I had signed in December 1995, there is nothing that forbids IDT account holders from expressing political speech, which would also be violative of the 1st Amendment. It appears that Commissioner Cranmer is stinging from political criticism and is abusing his powers of office to interfere with a contract between IDT and our organization. If as you had mentioned, the Commissioner’s Office could have a potential cause of action, their remedy is through the legal system, not through the pressure of an internet service provider suppressing free speech. I am not currently alleging this action as mail fraud. However, since there is no limitation to political speech in my contract, attempts by IDT to unilaterally amend my contract by placing a post hoc condition may result in a complaint to that affect. As you have so candidly pointed out, my organization has been a customer in good standing with IDT for a number of years. We wish to maintain that relationship without interference from outside forces. Before any action is taken, I am requesting that all written communication from Allegheny County offices be forwarded to our organization for review. I must respectfully ask your intentions regarding our web site before taking action, if we choose to continue keep this page as is. Please advise, Gary J. English; Chairman
